These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “You”, or “Your”) and North90 Digital Solutions Private Limited (“Company”, “North90”, “We”, “Us”, or “Our”), a company incorporated under the Companies Act, 1956, having its registered office at 58, Fathima Nagar, Thanjavur, Tamil Nadu – 613001, India.

These Terms govern your access to and use of the website www.consumerfirst.in, its related internet-based applications, mobile sites, and services (collectively, the “Platform”).

By accessing, browsing, registering, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, you must immediately discontinue using the Platform.

1. Description of Platform and Services

ConsumerFirst operates as a digital aggregator, advisory portal, and lead-generation platform. Our services include, but are not limited to:

  • Providing product comparison, financial product guidance, and informational content across various sectors.

  • Facilitating connections and lead referrals between users and third-party service providers, including regulated Banks, Non-Banking Financial Companies (NBFCs), co-lenders, credit bureaus, insurance providers, and affiliate partners (“Partner Entities”).

  • Assisting users in submitting applications for credit products, loans, credit cards, or other commercial offerings hosted by Partner Entities.

Intermediary Role: North90 is solely an intermediary providing a technological platform to facilitate interactions between Users and Partner Entities. North90 is not a bank, NBFC, registered credit provider, or financial institution, and does not directly extend credit, issue loans, or grant financial approvals.

2. Eligibility

By accessing or using the Platform, you represent and warrant that:

  1. You are at least 18 years of age.

  2. You are a resident of India with a valid permanent address and government-issued identification.

  3. You possess the legal capacity and authority to enter into a binding contract under the Indian Contract Act, 1872.

  4. All information provided by you during registration or application is true, accurate, current, and complete.

3. Account Registration and Security

  • Account Creation: To access certain features or apply for financial products, you may be required to register an account by providing personal details (e.g., full name, mobile number, email address, financial information).

  • Accuracy: You agree to maintain and promptly update your details to keep them accurate and complete. Providing false, misleading, or incomplete information constitutes a material breach of these Terms.

  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. You agree to notify us immediately of any unauthorized access or security breach at contact@consumerfirst.in.

4. Consent for Communication and DND Override

By providing your contact details (phone number, email, address) on consumerfirst.in:

  • You expressly authorize North90, its representatives, affiliates, and Partner Entities to contact you via Phone Call, SMS, WhatsApp, Email, or automated notifications regarding product information, loan applications, status updates, and promotional offers.

  • DND/NCPR Override: You acknowledge that this authorization applies even if your phone number is registered on the National Do Not Call (NDNC) registry or the National Customer Preference Register (NCPR) under the Telecom Commercial Communications Customer Preference Regulations (TCCCPR) of TRAI. This consent remains valid until explicitly revoked by you.

5. Partner Entities, Third-Party Products, and Credit Decisions

  • Independent Credit Evaluation: Financial products (loans, credit cards, etc.) listed on the Platform are offered and underwritten strictly by third-party Partner Entities (Banks/NBFCs). Approval or rejection of any loan or credit application is at the sole discretion of the respective financial lender based on their internal credit policies and risk assessments.

  • No Guarantee: North90 does not guarantee that your application will be approved, processed within a specific timeframe, or matched with a specific lender.

  • Third-Party Terms: When you accept a product or service from a Partner Entity, you enter into a separate legal agreement directly with that provider, governed by their respective terms, privacy policy, and loan agreements. North90 is not a party to, nor liable for, any dispute arising out of agreements between you and a Partner Entity.

  • Affiliate Links: The Platform may contain affiliate links, sponsored banners, or referral redirects. When you click on a third-party link, you are leaving our Platform and are subject to the privacy and operational terms of that external site.

6. Intellectual Property Rights

  • Ownership: All content, software, code, logos, trademarks, text, graphics, icons, and layout on consumerfirst.in are the exclusive property of North90 Digital Solutions Private Limited or its licensors, protected under applicable Indian copyright, trademark, and intellectual property laws.

  • Limited License: You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform strictly for personal, non-commercial purposes. You shall not copy, reproduce, modify, distribute, reverse engineer, sell, or exploit any portion of the Platform without prior written permission from North90.

7. Prohibited User Conduct

When using consumerfirst.in, you agree not to:

  1. Submit false, inaccurate, fraudulent, or forged identity/financial documents.

  2. Use the Platform for illegal purposes, money laundering, fraud, or violating any local, state, national, or international law.

  3. Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

  4. Introduce viruses, trojans, worms, logic bombs, or other malicious material that compromises system security or operations.

  5. Attempt to gain unauthorized access to our servers, databases, or network infrastructure.

  6. Use automated tools (robots, spiders, scrapers) to extract data or content from the Platform without authorization.

8. Data Privacy and Information Use

Your privacy is paramount to us. The collection, processing, storage, sharing, and deletion of your personal data, including Know Your Customer (KYC) compliance details and technical data, are governed strictly by our [Privacy Policy], which is hereby incorporated into these Terms by reference.

9. Disclaimer of Warranties

  • “As-Is” Basis: The Platform, content, materials, and services are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied.

  • No Financial Advice: Content provided on consumerfirst.in is for informational and educational purposes only and does not constitute financial, legal, or investment advice. You are encouraged to verify terms independently before committing to any financial transaction.

  • System Availability: North90 does not warrant that the Platform will be uninterrupted, error-free, timely, secure, or free from server outages or technical defects.

10. Limitation of Liability

To the maximum extent permitted under applicable law:

  • North90 Digital Solutions Private Limited, its directors, officers, employees, partners, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or services offered by Partner Entities.

  • North90 shall not be liable for any rejection of credit applications, errors in credit bureau reporting, fees charged by partner lenders, or acts/omissions of third-party service providers.

11. Indemnification

You agree to indemnify, defend, and hold harmless North90 Digital Solutions Private Limited, its directors, employees, affiliates, and Partner Entities from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising from:

  1. Your breach of these Terms or applicable laws.

  2. Misrepresentations or false information submitted by you on the Platform.

  3. Your violation of any third-party rights, including intellectual property or privacy rights.

12. Modifications to Terms and Services

North90 reserves the right to amend, update, or modify these Terms or modify/discontinue any aspect of the Platform at any time without prior individual notice. Any changes will become effective immediately upon posting on consumerfirst.in. Your continued use of the Platform following updated Terms constitutes your acceptance of the revised agreement.

13. Governing Law and Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any disputes or claims arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Thanjavur, Tamil Nadu, India.
